Hi, we are 55 years old and own an EC. If we intend to transfer the EC ownership to our 21 year old child, are we then allowed to buy a 5 room resale HDB flat without a wait out period? Or are we still subject to only allowing to buy 4 room resale flat or smaller without a wait out period? Thanks

Hi,

Yes it is the same be it selling in the open market or transferring to your child, you are still subjected to the wait out period of 15 months if you are looking at 5-room resale HDB and above. To avoid the wait out period, you need to go for 4-room resale size and smaller flat. The EC transfer is also not so straightforward, you child must have sufficient funding to refund your CPF utilized + accrued interest, and also enough home loan financing (if needed). He must also pay the relevant buyer stamp duties.

Hi,

1) Under the current HDB policy, anyone who sold a private residential property will have to observe a 15-month wait-out period before being eligible to buy a resale HDB flat.
2) The only exception is for those who are at or above 55 years old buying a 4-room and smaller flat.
3) As of the current situation, even those who meet the above conditions to buy a 4-room and smaller flat will still have to write to the HDB to be able to get an approved HFE for the purchase.
4) So if you intend to buy a 5-room flat without observing the 15-month wait-out period. I wouldn't be surprised that the HDB will reject your appeal immediately without hesitation. They are already having too much to chew at the moment with the one-legged HFE system.

5) The next is transferring the EC ownership to your 21-year-old son.
6) You have to understand that transferring property ownership is not just an administration process.
7) Legally, there are only 2 types of ownership transferring when the transferer is still alive, it is either via gift or sale.

8) If your intention is to transfer the ownership via gift. The first condition of transferring via gift is there must not be any outstanding loan.
(a) It would be easy if the property is paid fully by cash. The transferee will only need to pay the gift buyer stamp duty according to the market value, which is the same amount as the buyer stamp duty.
(b) If the property is partly paid with funds from the CPF, then all the utilized CPF funds must be returned with accrued interest.

9) If the intended transfer is via sale, then the selling and buying process shall applied accordingly.

You will only be able to purchase a resale 4 room HDB or smaller unit immediately after disposing yoru ownership in the current EC, otherwise the 15 months wait out period will still apply. Is the EC fully paid up in cash? If any CPF is used for the EC, your 21 year old child will be required to refund all the CPF monies used for this EC plus the accrued interest minimally, on top of paying the stamp duties applicable for the transfer. Alternatively, lawyers can receive and hold conveyancing money under escrow agreements between both purchasers’ and vendors’ lawyers. These are more relevant for complex transactions.

Hi,

As both of you are above age 55, you will be eligible to purchase a 4RM or smaller HDB resale flat without the wait-out period. In fact, if you have the ready funds, you can even purchase the flat first, and then transfer your EC ownership within 6 months.

However, if you wish to purchase a 5RM or bigger HDB resale flat, you will need to transfer the ownership of your EC, and then serve the wait-out period of 15 months before you can make the flat purchase.

Do take note that this measure is only temporary. HDB may lift this measure in the future when they deem that the HDB resale market to be stable.
