Hi there
the hdb flat im staying at currently is under my parent`s name
if my mum were to give her share of the flat to me after she pass away what should the procedure be like? Is drafting out a will enough or is there anything else need to be done? thanks in advance

Hi! In the event of a joint tenancy, the right of survivorship takes precedence over a will. For example, should an owner pass away, her ownership,will be automatically passed over to the surviving owner. This is regardless whether she has left any will.

Tenancy-in-common operates differently. Shold the same incident happen, her shares will be given to the named beneficiary.

Morning,

Your parent's flat should be purchased under joint tenancy, hence if your mother passed on, your dad will be the sole owner of the unit. If it's purchased on Tenancy-in-common, your mum can will her component to you. In the worst case that they pass on together, you and your siblings would share the unit equally.
