Hi there,

I recently paid the 5% deposit for a 5-rm BTO in Punggol Waterway recently which will e ready in 2016. I used my Singaporean daughter's name and Filipino wife name who is currently on 1 year visit pass.

Now she wants a divorce, can I tell HDB to remove her name and still keep the flat using my daughter's name and mine if I retain custody of my child? What if she manages to gain custody of the child, does it mean I loose the house and deposit? Please advise

Morning,

I would assume that your spouse is at least SPR to form a family nucleus for the purchase. For divorce case, it can take from 3 months to around 5 years to be completed. Hence it would depend on the type of divorce you will be getting into.
If you maintain the custody of your child, you have the rights to write into HDB and request to keep the unit. However, all is subjected to approval. And if you lose the custody, it's likely that you have to give up the purchase as you do not fulfill the family nucleus requirement.
