Hi there, I need clarification on agent fees please... If we are looking to make am offer for a two year contract on a condo where the asking price is 4k and we are offering 3.5k, who pays the agent commission- us or the landlord? I should point out that it is our agent who took us around to find the property. I have heard comments about if the rent is above a certain amount for a two year property the landlord should pay. Dear tenant,

You are right that in some cases if rental amount is above a certain figure for 2 years lease, the 2 salespersons (your salesperson and landlord's salesperson) will share the commissions, nevertheless, this is not standardised and is not regulated.

We have to consider what if Landlord's salesperson is unwilling to share the service fees collected from landlord so at the end of the day what happens to your appointed salesperson? As what Wilsen has mentioned, the regulation states that the salesperson cannot dual represent both landlord and tenant, meaning collecting service fees from both, as for the rest, it will be up for negotiation between the salesperson and their respective clients.

Hope this helps. For your information, I always quote my clients that service fees is payable usually for rental of 2 years at monthly rental of $4500 and below, but will still be subjective to the landlord's salesperson.

Hi, perhaps you like to check with your agent and negotiate with him first? As there is no right or wrong and agent fees are always negotiable. As for me, there are a few rental cases where I'm serving my tenant with rental of $3000 for a 2 years lease. And I chose to collect my commission from the landlord agent directly.
