Hi,
So the tenant stated in the LOI that one of the occupants will leave in February after staying for 3 months. So we signed the TA based on the information given in the LOI by the tenant. But now the tenant is saying that the occupant will continue staying in the unit.

What should I do now? Ask the tenant that I want that occupant out by end of February? Or increase the rent? How much rent can I increase for 1 extra occupant?

Deviation between LOI and actual TA happens quite often, and there are several options that you can take. The agent on your case should be able to advise what to do.

For starters, if the TA was properly drafted, you can refer to the wording on the TA on what is the recourse for various contract breaches.

If it was not properly drafted and it is now unclear, your agent can advise on enforcement, termination, renegotiation etc depending on what you actually want to accomplish.

Did the Tenancy Agreement indicate that the occupant will leave in February? The Tenancy Agreement is the agreement that is recognised therefore if there is no indication, it will be more challenging to remove that tenant or increase rent. Check with your lawyer to enforce the terms. Read More

Look closely at the Tenancy Agreement to see whether a February move-out date is clearly stated.

(✔2) Understand what holds weight
The signed agreement is what counts legally. If the date or condition isn’t written in, enforcing a move-out or rent change becomes harder.
