Hi property guru, I rented a hdb unit with 2 years lease with 3 friends. I have lost my job and EP pass was terminated. I have paid for rental for 14 months (include 1.5 months notice given) and offer to look for replacement but they refuse to accept and want to forfeit my deposit. Unfortunately our TA didn't include any diplomatic clause, how can i get back my deposit? Can i still exercise diplomatic clause?

Could i check if you're a malaysian on EP?

I'm sorry that given you've not include a diplomatic clause in your tenancy agreement. You're binded to complete the entire tenancy period after which your security deposit can then be returned to you.

it is unfortunate that you lost your job and subsequently your EP.
Without EP, you cannot work, or even live here.

You mentioned that THEY would not allow you to find a replacement.
Who are you referring to ? the landlord ?
Your agent, and Landlord should understand that.

It is not that you dont want to, but you cannot be staying here in Spore anymore.

The fact that your TA does not have a Dip Clause, you are at the mercy of the LL.

But again, there is not reason or excuse for LL to NOT allow you to find a replacement. Unless your are referring to your 2 other friends ?

You might want to go to HDB to report your case and seek their advice.

    Thanks dor your reply. Yes, my housemates don't accept my offer to find for replacement and said they will forfeit my deposit as I wish to move out from the house before the lease term end. It seems that it's low possibility I can get back my deposit. :(
