Hi, my spouse and I are SC, and have an EC that has MOP-ed. I am considering buying a new launch property under my own name for investment purposes. Would I qualify for ABSD remission if I decouple my EC within 6 months of the TOP of the new property? We do not wish to decouple now as we may have an opportunity to sell our EC before the TOP date and hence save on the decoupling fees.

Hi,

I understand the desired objectives you are trying to achieve, although unfortunately for ABSD remission it does not work this way, as under the eligibility conditions, one of the conditions is to purchase under joint name basis the next property and as a matrimonial property, and also to sell the existing matrimonial property within 6 months of key collection to the new one.

This means if you purchase the new launch under your sole name, assuming you did not decouple from the current existing property, the ABSD on the new launch is still applicable as its your 2nd residential property.

The decoupling fees, when weighed against the ABSD upfront costs payable, is typically a lot less significant. Hence this is why some of my clients are pursuing the decoupling upfront. Happy to illustrate for you based on your current scenario and in detail.

Dear Sir/Mdm,

You WILL NOT qualify for the ABSD remission because to qualify, you will need to purchase the new launch property as a matrimonial home ie to say both you and your spouse will need to be the owners of the new launch property. In this way, if you managed to sell the EC within a 6 months period from the TOP, IRAS will then reimburse you the ABSD that you paid earlier.

In my opinion, you may want to make a decision whether to keep or sell your current EC before proceeding further. This is because the ABSD amount involved is a significant amount. You may want to study the past price performance of similar projects in your vicinity and then decided whether it is worthwhile to go through the decoupling process.

Hi,

To qualify for ABSD refund, you will need to purchase the new launch property jointly, to be considered your first matrimonial home. This means that you will need to dispose off your current EC latest within 6 months upon the new condo TOP.

Also, for this situation, there is no ABSD Remission. You will need to pay ABSD upfront first, and then claim for a Refund after you had sold your EC. This is called ABSD Refund.

Hi,

1) ABSD remission is only applicable to matrimonial homes. Meaning your current home is registered with both you and your spouse's name, and the next (upgrade/downgrade) property also bought using both you & your spouse's name.
This is so as not to penalize a family who has a housing plan due to changes in their different state in life.
2) Every SC has the privilege of purchase his/her 1st property without incurring ABSD. 2nd count of residential property will consider as investment thus subject to ABSD.
3) In today's context, only staying in private property has the option of decoupling, this inclusive of EC that meets MOP. HDB owners will not have such privilege.
4) You will have to complete your decoupling process before pay the 5% option fee. The normal process of decoupling takes about 2 months if there is CPF involved. So you will be subject to ABSD if your decoupling is not complete before the exercise date of the new purchase.
