Hi Mrs Sam, I assume your purpose is to avoid the additional stamp duty for the purchase of the 2nd property. The process you are looking at is decoupling where one party will buy over the share of the other party and is usually managed through the lawyers and bankers. The procedure is the normal buy and sell through your lawyers. the challenges are to ensure that there are benefits to doing decoupling as there are costs involved. The party that is going to purchase the second property must also be able to loan the necessary amount needed for the purchase of the second property.     Thank you for the reply. its not just to avoid the stamp duty , but also because we want to buy yet another property. And if the current apartment is solely owned by me than he can buy another on the first house down payment % criteria.

Approach a lawyer to get the paperwork done. Assume that the party who is going to take over whole ownership has the financial capacity to finance the property, it should be a relatively easy process to do so.

What you are referring to is what we know as decoupling - which is technically quite common nowadays. First and foremost, you or your spouse need to have the financial capability to refinance the property under one individual. Thus forth, you need to get your property valuated and this pay the stamp duty of a minimum of 50% of the valuation of your property(which is also the transacted price between you and your spouse). Legal fees shall also be applied in this scenario.

After all the above is done, you can purchase your next property with no ABSD :)
