Hi,
My client a seller of a commercial property has signed a commission agreement which states that "..the vendor agrees to pay commission... and also the vendor's solicitors shall accept this agreement as vendor's irrevocable authority to retain the commission from the sales proceeds and to pay my agency upon completion of the sale of the property".
However, when I called the solicitor's office today to ask to collect the cheque for the commission, I was told that the vendor shall settle with me.
I do not wish to deal with this client who had earlier requested for some money out of this commission and I had ignored him.
My agency is a small one and we do not have a legal department to advise me.
I would appreciate any good advice as to how to handle this situation.
