Hi. My buyer and I signed a mutual agreement for temporary extension of 2 months. Closer to the signing of completion date, the buyer suddenly decided that they want to cancel the contract and want me to move out immediately. My next flat is under renovation and I need the 2 months extension. The thing is I decided to accept the buyer’s offer despite being lower than my asking price because of the agreement of the extension of stay. Does that mean that the buyer can just cancel the mutually signed agreement without any legal repercussions? I’m in bind cause if I had known they want to breach the contract I wouldn’t proceed with the sale and accept their offer. Thanks for your advice

Dear sir/mdm,

Without understanding the full context of the sales and purchase agreement, on top of the mutual agreement signed for temporary extension, we will be unable to advise or give an opinion. In fact, your representing agent should be able to advise you better in this scenario.

Is this for a resale HDB or private home? There are different managing methods for temporary extension for the different properties, and for resale HDB transactions, the maximum extension period allowed is 3 months and it has to be submitted during the resale application phase. For private resale properties, the extension is usually inked within the Option To Purchase as a legal binding agreement and further extensions should be communicated by the lawyers.

Hi Sir

Do refer to your agent on the best way to settle this issue as HDB will not assist to mediate or dictate of the terms of the extension of stay as it is deemed as a private arrangement between sellers and buyers. For private properties, do consult your lawyer on this.
