Sorry to hear the situation that you are going through, and hope things get better for your end. As for your situation specifically, assuming that the EC has hit 5 years MOP, you can proceed to sell the EC.
Once you’ve sold the EC, and since both you and your spouse are both aged 55yrs and up, you can proceed to buy a resale HDB unit individually without serving the 15 months wait out period. But it has to be 4rm or smaller.
Buying a 3rm or 4rm resale hdb under 1 person + 1 essential occupier (within same family nucleus) is possible. Of course, the essential occupier cannot have any other property under his/her name. There are also other eligibility criterias to check (E.g., income ceiling for hdb loan, etc) but this can be discussed for later.
As for the other spouse to buy the separate unit under single scheme, it is also possible since min age requirement of 35yrs is of no issue now. But of course, yet again, there are other criterias to check.
But most important criteria to check before being able to buy a resale HDB unit individually is your marital status at the point of HFE application (I.e., Need HFE to buy resale HDB, regardless if taking bank loan or HDB loan).
It has to be of divorced status to be eligible to buy individually.
Thus, if marriage is more than 3 years, then we would need the Final Judgment / Divorce Certificate document. If uncontested divorce, then it would take 6-9 months to get the Final Judgement / Divorce Certificate.
In terms of the sale of the EC, best to have the court order document to state the division of matrimonial assets so that the sales proceeds division between you and your spouse is written black-and-white.
Best option moving forward would be to decide if you and your spouse decide to get official divorce proceedings to start. This is required to get your Final Judgement / Divorce Certificate document, which is required for your HFE, which is required for your resale HDB purchase individually.
If marriage is more than 3 years, which I’m guessing it’s the case for you, then a deed of separation isn’t sufficient for you to provide to HDB to buy resale HDB units individually.
Because if deed of separation is done, and you proceed to sell the EC, and have the sales proceeds apportioned according to what you and your spouse agree in the deed of separation, there would still be an issue of buying the resale HDB units individually because there isn’t a divorce certificate to provide to HDB.
