I would like to enquire if I am still eligible to apply for a BTO with my partner (C) if:

I applied for EC property before I was 21, with another person (B) whom was above 21. At that time, since I was under 21, I was placed as an occupant but still under fiancé/fiancée scheme. However, the relationship was broken off and I opted out of purchase. The other partner (B), continued to hold on to the EC in an attempt to put another person’s name to replace me, whom has opted out. I have a letter from the developer's lawyer stating that they acknowledge that I will no longer be participating in the purchase of the EC, hence, (B) is deemed ineligible unless (B) forms a new family nucleus, with my approval.

I now wish to apply for BTO with my partner (C) but wonder if I am eligible as I am worried that my name is still under the EC. Thank you.
