Hi

i was living in a co sharing house private estate, in which we payed 2 months security deposit to the main tenant. Is it normal for them to hold deposit while waiting for someone to take over our room? As it was stated in contract and the tenant, that deposit will be retuned within 14 days. But after 3 weeks, main tenant says that there's no one occupying room yet so they had no money to give us back. They didn't inform us before that we had to wait for someone to occupy the room first. Can someone advice me about this situation pls?

Thanks in advance

From your description, it sounds like you are breaking your lease before its expiry, hence the need for the landlord to find a replacement tenant? If that's the case, then it may be hard to argue against the landlord holding on to your security deposit.

If you have completed your lease as per your agreement, and the landlord is still withholding your deposit without a valid reason, then the landlord may be at fault.

What I described above is just a general case, and it comes down to what your specific arrangement was and what the contract stated. Happy to learn more about your situation if you reach out so I can understand further in detail.

Hi there,

Sorry to hear you’re going through this — you’re right to be concerned.

If your contract clearly states that the deposit will be returned within 14 days, then the main tenant is legally bound to honour that, regardless of whether a new tenant has taken over the room. It’s not normal or acceptable for someone to withhold your deposit due to their own cash flow issues or inability to find a replacement tenant — especially if this wasn’t disclosed beforehand.

In your case, the main tenant may be subletting illegally or informally, which can further complicate things. You could consider:
1. Sending a formal written request (email or message) stating the contract clause and politely requesting a firm date for the deposit return.
2. If they continue to delay, you can escalate by filing a Small Claims Tribunal (SCT) case with the State Courts. The process is relatively straightforward and affordable in Singapore.

Let me know if you want help drafting a message to the tenant. Wishing you all the best sorting this out — feel free to reach out at 96576701  if you’d like to speak with someone familiar with rental disputes.

1. If you’re **ending your lease early** and the landlord has to find a replacement tenant, it’s usually difficult to contest them **keeping your security deposit**.

2. If you’ve **completed the lease as agreed** and the landlord withholds the deposit **without a valid reason**, then they may be in the wrong.

3. Ultimately, it depends on your **specific agreement and contract terms**—feel free to share more details so I can better understand your case.
