Hi,

I recently moved into a new condo with my wife and our newborn baby. The agent did not tell me about construction next door which began less than a month after we moved in.

Am I within my rights to ask to move without incurring any penalty fees? Or is there anything else I can do here?
Trying to put a baby to sleep with the construction noise is terrible. We would not have moved here had we known about it.

Hi Raza,

You can try speaking to the landlord for you to find replacement tenants for your apartment citing the reasons you have just mentioned and work things out with the landlord with your agent's help. I can imagine how it feels to be in such an environment being a father of 3. If landlord is reasonable I believe he/she is likely agreeable with this suggestion, otherwise you have absolute no grounds to back out of this tenancy, unless the agent made it a point to hide from you about this construction when you have enquired about it, you probably have a case to bring up.
