I recently bought a condo with tenancy till end of the year. I intend to move in once the tenancy ends. Just like to seek advice on a few questions
1) When the tenancy ends, can i hold on the deposits past the tenancy to ensure utilities, phone bills are paid before I return it ? (Reasons being normally incurred charges are billed the following month and I won't know if this is cleared).

2) Does the agent who handled the original tenancy (with the tenant and the original owner) have any obligations to see that it ends smoothly for me ?

Hi Yxez,

Usually, you should have a clause in the tenancy agreement that states you can hold on the security deposit for a maximum of 14 days from the tenancy end date. If the SP account is under your tenant, it does not reallly affect you. When you apply the new SP account under your name, your new account is independent from your tenant account. Even if you tenant never pay the last bill, SP Service will only go after the old account holder and not you.

Your agent does not have a obligation in black or white to service you till the end. Sometimes, the agent might have left the trade. But usually this is a common value added service that professional and long term agent will provide to their client. Read More

Hi Yxez, when the tenancy ends, you have up to 14 days to do a refund of the deposit back to the tenant.
