Hi I like to ask if say we engage agency to rent out our hdb unit to foreigner holding valid passes(example wp or sp).What if the foreigner go n gather his friends (more than hdb quota of stayers in the hdb unit) or go and rent out to ppl without passes and if hdb wants to collect back our flat due to this. Can we sue the agency or if not how to prevent this? Or where can we claim against? Or what's the best option for us? Actually my family has a unit for rent but because of this, holds us back

understand your concerns, you do not have to be afraid as the tenancy agreement clause will be there to protect your interests.

Dear Mr Chan,

In doing so, tenant has already violated the terms and conditions of the tenancy agreement and you may seek legal proceedings against the tenants who violated the agreement. Upon finding out such an incident, HDB investigate into this issue together with you as a landlord. I have personally handled a rental which had this issue and the tenant was evicted from the place within 24hours. As the agent has no control over the tenant, there is no case against the agent unless the agent has misrepresented in the transaction.
