Hi I currently am renting my common room. The contract is 6 month, but the tenant decide to leave before 6 month. The tenant entered my house on 26 june and she handed me the 1st rental that is $700, subsequently month on the 26 july she paid her rental. On august when I ask for the rental fee she decline to pay as she say she already paid 1 month advance, and she would like to leave on 26 september. So after I explain to her that her deposit will be forfeited and she will need to pay me the august rental that cover her stay till 26 september. And today she decided to leave on 17 september any she request me to refund her balance which is cost $175 according to her. I called the agent and I told him that she is serving her 1 month notice and if she will leave early I will not refund her. But the agent told me that the tenant can lodge a report to case. So I wondering if I suppose to refund her back?

Evening,

Depending on what is being written on your TA, both of you might have a case to fight on. However, your agent should be well aware that all TA for residential unit have to be valid for minimum of 6 months.
