Hi, I am the buyer of a resale HDB, which is set for completion on mid May (collect key). Everything was smooth until this week the seller agent msg to ask for extension till Jun but didnt offer to pay for this extension. This HDB unit is rented out to a tenant even though the MOP not yet 5 years, so I was very uncomfortable when I found out about this and how the owner was dealing with such illegal thing. I disagree with the extension and told the agent to stick to official completion date. Then, today i went to see the unit with my ID to take measurement. The tenants seemed ok but we noticed the house wasn't packed at all, it didn't look like it is ready to move out before the completion date at all. My ID said this tenant looks quite fishy, and the next second, the tenant came down to look for us when we finished our visit and was talking at the void deck. The tenant asked for my contact number, which i rejected. Then he demanded me to let him stay till July. Which of course I rejected. He started saying things like how he couldn't find a place and his agreement with the owner was till July. I told him to settle this with the owner but he kept demanding me to allow him to stay, and he also said the owner is not picking up his call. My ID stepped in to help as it was getting creepy and kind of dangerous. I called the seller agent but he is never picking up the phone. I can only contact him via whatsapp msg and he would never reply my messages. Please, is there a way to ensure I can get the house on the completion date smoothly, and how to deal with irresponsible agent and seller?

All transactions come with element of risk, and I think in this case, this extension request by the tenant will be the biggest headache for you to manage. As much as we can say that from legal standpoint, you have every right to enforce the terms and conditions of the sale as per earlier agreed, the key will be how should you enforce such terms and conditions.

Do you know the background of this tenant? Are they local or on Employment pass? As real estate agents, we are not in a position to enforce the terms and conditions in a legal agreement, therefore it is in your best interest to consult a lawyer in this case on how you should go about managing this incident.

Hi, in your case and if the seller refuse to proceed with normal completion, one of the options is for you to sue but usually that be the last resort.
