Hi, i am one of the beneficiaries for a property under a Will. The will states that sales proceeds will be distributed accordingly to the Will. However, the Will didn’t state that the property ownership will be transferred to the beneficiaries. My questions are :
1) Who is the Legal Owner of the property after Grant of Probate is issued? Is it the executor/trustee?
2) If the legal owner is the trustee, how to settle the monthly loan installment? Who is the responsible party to pay the installment?
3) Does the trustee need to engage a property lawyer to settle?

Hi,

It would be advisable that you approach the law firm that is handling the matter of the Will and you would have a clearer understanding from them.

With matters concerning property distribution under a will, it is best to consult a lawyer and seek proper legal advice. An executor is usually named in the will. Feel free to contact me so that I can refer a helpful lawyer to you to provide you with legal advice.
