Hi, I am currently residing in the US and I won't be coming back to Singapore any time soon in the next few years. I like to rent out my 3room HDB but I don't have a power of attorney. Will I be able to rent it out by handling the paperwork's online? My nephew in Singapore is currently holding on to the keys for the flat.

Since your nephew has the keys to your unit, what stops you from designating him as the Power of Attorney? If that's not an option, we can arrange for the Tenancy Agreement to be signed electronically through DocuSign or AdobeSign. You are able to rent out your HDB without a POA appointed however, perhaps I can explain better why it could be a good option to have a Power of Attorney appointed.

### 1. **Tenancy Agreement Signing**

* **Without POA**:
You must personally sign the tenancy agreement (TA). That means either:

* Printing and couriering the TA back and forth between the US and Singapore, or
* Using digital signing — but some tenants, agents, or even banks (if tenant needs to register address) may still insist on a wet ink signature.

* **With POA**:
Your nephew (or whoever you appoint) can sign on your behalf in Singapore immediately — no courier delays, no tenant worries about “landlord not present.”

### 2. **HDB Application Submission**

* **Without POA**:
Only you can log in with Singpass to submit the rental application to HDB. This means you’ll always need to be involved online.

* **With POA**:
Your attorney can submit the HDB application and declarations on your behalf, freeing you from having to log in at odd hours due to US–SG time zone difference.

### 3. **Handling Tenant & Property Matters**

* **Without POA**:
If issues arise (e.g. tenant requests extension, renewal, or HDB queries additional documents), you must personally handle all approvals. Your nephew can help with keys and inspections, but legally he has no standing to represent you.

* **With POA**:
Your nephew/agent can respond directly, negotiate lease renewals, and submit updated paperwork without needing to bother you each time.

### 4. **Future-Proofing**

* **Without POA**:
Every renewal or change (like adding/removing occupiers, or if you want to terminate early) requires you to be involved again.

* **With POA**:
Your appointed attorney can handle all future tenancy renewals, variations, and even other property-related matters (e.g. utilities, sale later on).

I assume your MOP of 5 years are fulfilled. For HDB rentals to be approved by HDB, you will need a legal Power of Attorney to be done up. It is one of the documents required for rental approval. So you have to appoint someone in Singapore as your POA.

You can engage a law firm in Singapore to draft up a POA for you, and they can share more on the next steps. If I am not wrong, they will courier to you the documents to go to the Embassy in US for it to be notarized.

You can rent out your HDB even if you’re overseas, but there are a few important points:
1. HDB Approval – HDB requires owners to submit the Tenancy Approval application. This can be done online through HDB’s portal.
2. Power of Attorney (POA) – Since you’re overseas, having a POA makes the process smoother. Without one, you may still submit applications online yourself, but signing the tenancy agreement and collecting keys may require someone in Singapore to act on your behalf.
3. Nephew Holding Keys – Your nephew can assist physically, but legally, he cannot sign documents on your behalf unless you provide him with a POA.
