Hi Gurus, After my HLE been approved, my husband(citizen) and i(SPR) had signed an agreement with our property agents on a resale unit that we are keen to buy. But days later, HDB called up saying we are not eligible for Housing Grant because we did not fulfill the terms of 'dispose private property in 30mth'. Then we try to appeal as our agent did not highlight to us throughout the buying process. Later, HDB called up again saying they have to cancel our HLE back to the same reason again!! We are totally stress up and really feel sad on our agent of not highlight the consequences to us earlier. Therefore, i wanna know whether we have the right to cancel this sales with the agent or not? Do we have the right to do so? or Do we have the right to deduct the agent's commission?

Hi Mrs Goh Looking at your question, I believe you have already paid the $1000 option for the resale unit, and are now applying thru the bank loan instead?     Hi Aaron, you are right, i'd paid $1k for the resale unit. My husband and i are in the midst of appealing on restoring our HLE and Housing Grant. But if we fail to restoring the above, can we cancel the sales with the buyer without penalty and can we penalized our agent too?
Morning Ms Goh, As per HDB regulations, HDB buyers will not be eligible for HDB loan if they have disposed of their private property within the last 30 months. Your agent should have advised you accordingly. As to whether to cancel the deal, you might need to talk to your sellers about it, teling them about your situation.
