Hi Guru,

In my contract there is a renewal clause (see wording below). It states that the landlord shall grant to the tenancy the said premises for a further term of 2 years against a mutually agreed price. What happens if the landlord does not want to negotiate a price as they wish the tenant to move out of the premises (as they want to live in the house themselves). Has the tenant any right? And is there a thing as an unreasonable rent increase?

he Landlord shall, on the written request of the Tenant made not less than three ( 3 ) months before the date of expiry of this tenancy, and if there shall not at the time of such request be any existing breach or any non – observance of any of the conditions, covenants, or stipulations on the part of the Tenant herein contained, at the expense of the Tenant, grant to the Tenant a tenancy of the said premises for a further term of one ( 2 ) year from the date of the expiry of this tenancy at a rent to be agreed , based on the prevailing market rent, but otherwise containing the like conditions, covenants and stipulations as are herein contained, with the exception of this option for renewal. The tenant shall sign for the new tenancy no less than

Hi Bart,

The renewal can’t continue if either party does not agree with the new terms. And yes, landlord reserves the right not to continue renting the unit too and tenant would have to vacate the premises upon the end of the lease.

The tenancy renewal clause and agreed rental should have been stated clearly in the beginning and mutually agreed by landlord and tenant. If tenant finds increase in rent unreasonable, of course he/she has a right to:

Negotiate with the landlord: The tenant can try to negotiate a lower rent increase or a longer time frame for the increase to take effect.

Seek mediation: If the landlord and tenant are unable to reach an agreement, they may be able to resolve the issue through mediation or other forms of alternative dispute resolution.

Challenge the increase in court: If the rent increase is significantly higher than what is considered reasonable, the tenant may have grounds to challenge the increase in court.

Hi Bart,

Basing on the tenancy agreement signed, I understand that the tenant has a right to renew if he has the intention to do so, but the argumentative point here is how is the prevailing market rent determined in this instance? If the landlord is not keen in renewing, he or she will likely be expecting a significant rent increase and will look for ways and means to justify the increase. As long as there is no agreement to the revised rent signed, the renewal is not effective and even if you bring this matter before the court which I feel it is not a practical way to resolve this conflict, it will take some time to resolve and also at the end of the day, the only benefit you get is to stay on in this unit UNHAPPILY with many inconveniences experienced along the way.

Will finding another place for rent be a more practical way instead? It is your call to make.
