Hi Guru, I recently bought a property with tenant in it. 3 months before the lease expires, the tenant contacted me for renewal. So I drafted a new contract and get him to sign. Now the problem is 1 month after the new contract is signed and stamped, the agent came knocking and asked for his commission. He then showed me a contract made between the old landlord and the estate agent. Basically the contract says that owner has to pay 1 month commisssion for renewal. I told him that I didn't know that such contract between the old landlord and the estate agent existed, and I didn't sign it, the old owner signed it. Question is do I still have to pay agent commission for the renewal, even though I didn't sign the contract in the first place? It seemed a bit ridiculous paying $7000 for doing nothing, not even for typing the new contract, which I did on my own. thx

Hi Jason, It is quite subjective therefore I believe it will be good to check with your legal representatives instead if real estate professionals. One point I would like to ask is if you will proceed with purchasing this property if it had been made known upfront to you that commission is payable upon the renewal of tenancy? Come to think of it, wouldn't all salespersons who secured the rental transaction be at the losing end when units are being sold with tenancy? The hard work put into marketing the property for existing rental and having an agreement to be paid during renewal is also significant. If this unit you have purchased was sold to you on vacant possession and you have to seek the salesperson help to market the property for rent, you would also be paying out commission. Worse case will be having the unit vacant for a couple of months during the marketing process. No hard feelings please, as I am purely stating out the feelings of a salesperson who has put in efforts to carry out his professionalism should not be shortchanged and does not reflect that you should be paying. Hi Jason, Think of it, if the existing tenant decides not to renew the lease, would you be moving into the unit and rent out/sell your existing place or seek new tenant for your purchased unit? Under both circumstances, perhaps you may also be paying out service fees therefore in this scenario, although the renewal was done by without the notice of the salesperson 3 months before renewal, you do have a case. However, it will be good to read the tenancy agreement to check when should the renewal intentions be made as my understanding is that it should be done 2 months before the expiry, therefore it could be a reason why the existing salesperson was not there when renewal was done.
