Hi Experts, I would like to ask, if I engaged an agent (non exclusive) prior to getting another agent (exclusively) but the previous agent (non exclusive) buyer decided to purchase the property instead, will I be liable to pay both agents?

What was your agreement with your non-exclusive agent in the first place and why are you thinking about granting exclusivity to the other agent now?

If the non-exclusive agent has been putting in the effort in marketing your property and bringing buyers as well as pushing buyers, without tying you down with an exclusive agreement, why are you then looking to sign an exclusive with an agent who has not done anything so far and why not just allow both agents to work on the listing instead of checking on your liability? If both agents are allowed to work on the listings, there is no liability to pay both agents in this case isn't it? Read More

Hi,

1) You are not supposed to sell to the buyers who were introduced by the 1st agent (non-exclusive) because your unit is supposed to be marketed by the current agent (exclusive) to avoid complications.
2) If you decided to sell to this buyer. You will have to pay a full commission to the 1st agent as per the agreement you signed with him/her.
3) You might have to compensate the current agent for the marketing cost and effort accordingly. There are no fixed rules on this.
