Hi!
Currently I'm staying with my siblings and mum.
This house is under my mum and brother name, fully paid off. My brother is married but we don't want to add his wife name to this property. Can we write a will state that this property is shared among all equal share, in the event my mum pass away, my brother cannot hold the whole property as his own. If he want to sell the house, everyone of us have the equal share of the property value.

Can someone pls guide me how shld
I write this will and who should sign and keep?

Morning Rainbow,

If your unit is an HDB, under joint tenancy, the answer is NO. Under the ruling, the joint tenant will automatically become the sole owner of the unit. If it's under tenancy-in-common, be it HDB or private, your mum can only will her portion to someone else but your brother still have his rights over his share of the unit.

If you are getting a WILL drawn up, it doesn't matter who keeps the WILL as the executor will be the one executing the instruction. This will also be dependent on how the WILL is drawn up.
