Hi can anyone help me to explain about CPF ruling, if possible can show me the example of calculation.

Court Order
Defendant CPF Account To Transfer From

Amount To Transfer
62%of the total amount refunded to both parties Cpf Account pursuant to the sale of the matrimonial flat, " LESS" the amount refunded to the Plaintiff CPF account.

This is what am trying to understand the cpf calculation e.g

Defendant CPF using for flat include interest is: $80,000 + OA $12,000 = $92,000
Plaintiffs Cpf using for flat include interest is $102,000 + OA $95,000 = $197,000

Total Cpf used for the Flat is $182,000 without add on the both OA.
If only by Cpf return without OA
$80,000+$102,000=$182,000
62% $182,000 = $112,840
112,840 -$102,000 (plaintiff)= $10,840
112,840 - 80,000 (defendant) $32,840

If included the Both OA and cpf return
$197,000 + $92,000 =$289,000
62% of $289,000= $179,180
$179,180 - $197,000 ( plaintiff)= $17,820
$179,180 - $92,000 ( Defendant) $87,180

The confusing part is How much Does The Plaintiff should receive from Defendant??

Please explain.

Hi Pearl,

1) Seems like this is a divorce case if I'm not wrong.
2) In general, the division of the property share might not be as complicated as you have thought.
3) You are assuming that both parties will distribute according to the amount of CPF utilized.
4) But in actual case, it can be 50/50, 60/40, 70/30, etc.
5) If it is a 50/50 share division, it is not on the amount that each party contributed but according to the valuation of the flat since this is a transfer case.
6) So it is not so complicated. Assuming the flat market rate is $500k, then each will take $250k.
7) The defendant will just need to pay $250k to the plaintiff accordingly regardless of the CPF utilized.
8) Finally you will have to get the final court order before starting any transferring process.
