In fact under current law society rulings, balance 4%/ 9% should be addressed to the lawyer rather than the seller. This is done so as to protect the interests of the buyers if anything goes wrong in the deal.

Its better just to lose 1% rather than 5%/ 10% right?

Probably the salesperson who is representing your mum does not clearly explain the procedures to her.
