HDB owner suddenly passed away leaving behind mother and spouse who has never contributed to the house but just a foreigner (non-pr or citizen) officially ROM when she came to Singapore.
Spouse (Granted letter of Administration) is going to sell the house away to get the money, the deceased mother will be evict/homeless (daughter married out already).

1. Any law in Singapore to protect the elderly mother?
2. The elderly mother when gets her 50% share from sale of HDB also can't afford to buy a house on her own. Any case to "fight"with the spouse to retain the HDB?
3. After selling the HDB, will it be possible the spouse takes the cheque and not pay the mother 50% or the share? Or HDB will help to distribute 50% - 50% accordingly to them?
4. Can the law make the spouse pay the mother maintenance fees and etc? The mother was all along depending on her son when he was alive.

Hi,

1) It is mandatory that all HDB homeowners purchase insurance known as Home Protection Scheme when using CPF or loans from the HDB. This insurance will pay the outstanding mortgage settlement, up to the insured sum when there is any mishap that happened to the insured person.
Usually, this insurance will not be able to cover the interest incurred to date. Thus there will be some outstanding amount if decided to keep the flat. You may find out more detail under this link:

2) If there is no will from the deceased, the property will distribute under the succession act. Since the spouse is not SPR or citizen, she is not allowed to hold a title on the HDB flat, thus it is human nature for her to decide to sell the flat away in order to protect her interest.

3) The cheque issued from HDB will bear both mother's and the spouse's name under normal circumstances. If you wish to have it split into 50-50, you will have to check with the HDB officer who is in charge of the transaction on how it can be done.
The email address of the HDB officer will be indicated in MYHDB after the resale application is accepted.

4) Current there is no law that I'm aware of that enforces children paying their mother maintenance fees. She will have to seek assistance from the Ministry of Home Affairs on her case. You may find their contacts under this link:
