Hi Gurus ,what actions can a landlord take if tenants gave less than one month notice for moving out ? The TA is ending in one month's time btw.

example : TA is ending on June 31st and due to a disagreement on renewal rentals they decided to move out and gave notice on 3rd/4th JUNE. Is this considerer a breach of tenancy and what can we do about it.

Hi Steve,

We cannot be sure as we are unaware on the terms and conditions of your existing tenancy agreement. In most cases where there is no premature termination clause, the tenant is liable to pay for whatever period that has not been fulfilled and if they have broken then agreement terms, the deposit can also be forfeited.

In this case, where there is an absence of renewal agreement concluded, they are free to move out at the end of existing tenancy and depending on the agreement, they are likely required to allow viewings of the premises for new prospective tenants. This is a reason why I will usually conduct discussions for renewal 3 months prior to the expiry of lease so both parties have ample time to consider and discuss so as to not leave all to the last minute.
