Dear Gurus,

i would like to ask about my current rental contract. we are planning to buy a private property next year, however i am still renting at the moment (coming feb 2018, i will finish 1 year contract period)

since the plan is to buy private property on q4 2018, i wonder if there is anything i can do to have a more flexible rental contract for 2018, eg: notify landlord 2 months in advance before moving out.

is there any clause that need to be mentioned in the rental contract?

Hi Mr. Erick,

It seems like you need a flexible leasing rather than a fixed leasing to tie you down.

There are no harm talking to landlord regarding your situation.

There are no clause in a standard unit leasing that provide such flexibility.

You will have to insert an additional clause with landlord consent, to allow you to terminate the lease upon finding the right property.

To be fair to landlord,
(a) You can promise a minimum month of stay before allow to exercise this clause, and,
(b) Give the same notice period of 2 months just the same as normal fixed term lease, to allow landlord to get a replace tenant.
(c) Dependent on the number of months stay (less than a year) compensate landlord on the agent's fee in proportion.

2 months notice might be tight for you as a private transaction might take 8~12 weeks for completion, you may also consider to give "3" months notice in this case. As you may want to do some minor renovation before shifting in.

Hi Mr. Erick,

Do you meant that you have signed a 2 year lease and the contract is expiring on Feb 2019? Or that its up for renewal in Feb 2018? If the latter, its always possible to sign a shorter lease since minimum tenancy period for private properties is 3 months.

Depending on your timeline planning for your purchase, you may wish to renew your lease with your landlord on a xx month basis, instead of a 1 or 2-year lease. The minimum allowable lease is 3 months.

Hi Erick, yes no issue for your case as you could do a short term lease like 6 months on a renewal basis the moment your current lease has ended. I’m sure your landlord would be glad to retain you than to get his agent to advertise for the unit all over again. Pls feel free to let me know if you need any assistance.

You may renew for another year and insert a clause to say you can serve 2 months' notice to terminate the lease in the event that you purchase a property.

Hi Mr Erick,

First I wish to congratulate you on your decision to purchase your own private property!

For your case, there are actually quite a few options. I guess one of the easiest will be to discuss with your current landlord to extend your current lease and add in more flexibility during your extension of the lease. Of course the next option will be to find another rental property and rediscuss the terms and conditions with the next landlord.

If your current landlord or the house that you're staying is not giving you any problems, then maybe you should really consider renewing the lease with the current landlord. Then you will not need to move twice and since you have already decided to buy next year.

You mentioned that you will be making the purchase in Q4 next year and we need to aware that which part in Q4 that you're buying also makes a difference in your time line planning. If you are making the purchase near to the end of Q4 then by the time the transaction completes and also factoring some time into some renovations for the new house, you may end up in Q1 2019. We also need to note that if the renovations falls into the Chinese New Year period, then you will experience shortage of manpower and that will further add on to your timeline. So all these definitely need to be taken into consideration.
