Dear Guru , I understand that for a mentally incapacitated person to buy a HDB resale flat he needs to appoint a Deputy approved by the Court to help him to buy a HDB resale flat. What if a person is mentally capacitated and has applied for Lasting Power of Attorney to grant the donee the power to buy a HDB resale flat on his behalf if he becomes mentally incapacitated. Will Hdb approve the donee to do that when the donor becomes mentally incapacitated? Can I go down to HDB to enquire about this? If so , which department and where should I go to enqiure about this?

Evening,

Under Mental Capacity act, HDB might not be able to assist you further other than asking you to approach the lawyers. Since Lasting Power of Attorney have being prepared, you can obtain a court order before you proceed. I would also assume that the donee is aware of the duty which have to be undertaken.
