Dear experts,

In a HDB resale transaction, after buyer exercise of option, what is both seller and buyer can't agree of the submission date? For example, seller need to drag the submission as long as possible and buyer need to move in as soon as possible. In this situation, who will have the priority to make the final decision for resale submission and to select date for first appointment or even completion date? or what will be the final resolution if both can't compromise on the dates?

Hi, such issue would have already been discussed and sorted out before the buyer exercise the option.

Hi,

This is part of the negotiations process and your interests would have been looked after and should have been advised accordingly by your agent before any OTP is signed. If you are uncertain of the resale process, will recommend to engage an agent who is professional and you can be comfortable with. The entire hassle and potential legal costs can be overwhelming, in most of my clients opinion the relatively low savings are not worth it. Thanks and hope to assist further.

Evening,

Both buyers and sellers are supposed to understand each other's requirement before even starting to view the unit. Based on this, I would assume at least the buyer are doing a DIY purchase. Since the OTP have being inked, you will need to refer to the number of days for submission after exercising the OTP. Should either party default on the submission, legal actions can be requested.

Dear seller,

Both of you may wish to re-discuss the terms and conditions in such a scenario and see what best fits both of you (assume that either 1 or both parties would require to compromise to some extent for this transaction to proceed), otherwise it maybe beneficial for both of you to renounce the transaction and Option Money returned to the buyer.

I am unsure of what part are you playing in this transaction but if you are 1 of the salesperson representing either party, there is quite a fair bit of works to be done in this instance to convince both parties to compromise.

This is where the experience of a salesperson will come in handy to benefit both direct sellers or buyers in a real estate transaction. We know that there is vast amount of information readily available for the consumers to rely on (transacted prices, HDB resale procedures, mortgage arrangements and packages and etc.), however it is likely that a direct buyer and seller does not have the amount of experience in dealing with such unexpected matters arising from a transaction, which will definitely benefit both parties when an experienced salesperson is in place.
