Can seller back out of a hdb sale after all document and fees have been paid? Waiting to go hdb collect key in May but suddenly the seller wants a 3 month extension but doesn’t want to go thru HDB. And they threaten not to go for the HDB appointment in may.

Hi, at this stage, both seller and buyer cannot back out anymore. If the seller threaten not to attend the HDB completion, one of the options will be for you to sue.

Upon exercising the Option To Purchase and HDB approving the resale transaction, both Vendors and Purchasers are in a legal binding relationship to ensure that the deal goes through. Enforcement of contractual obligations can only be initiated through the proper legal channels, and should HDB be acting on behalf of you in this purchase, you will require to speak to a private lawyer on how you should proceed further in the event that this becomes a legal suit.

As the OTP has been exercised and resale transaction has already been submitted to HDB, neither party can legally back out from the deal.

However, having said that, should the Seller still insist to back out from the deal, HDB will not pursue the matter and the transaction will not be completed. HDB will advise the Buyer to engage a private lawyer for a legal suit to claim damages.

    Hi, i choose contra transaction and the process date is 2weeks from now. Received reply from hdb that contra facility not possible reason because my husband has applied for MGS so now we need to wait 2 weeks for his cpf to be in his OA for our next purchase. Now seller disagreed to wait for that 2weeks and insist for a compensation which we do not agree to it. My question how do we proceed from here and stick to the purchase date which hdb has given once my husband cpf is in to the OA, thank you.
