As my tenant has feedback that the aircons in the 3 bedrooms were not cold due to gas pipe leaks, I have arranged for replacements with System 3 (3 aircons + compressor) and change the gas pipping. Minor repair clause is for tenant to pay $200 per item per repair/replacement, kindly advise how many units are these in total? Thank you.

Minor Repair Clause is as follows:

Throughout the term any damage to the premises or the fixtures, fittings and appliances shall be duly notified to the Landlord by the tenant. For minor repair and/or replacement of any single item not exceeding $200 per item per repair/replacement shall be borned by the tenant. Such expenditure exceeding $200 per item per repair/replacement tenant will have to obtain Landlord’s prior consent in writing before proceeding with the repair/replacement. The excess amount will be borne by the Landlord upon the production of payment evidence or receipts, provided that any damage requiring such repair is not due to the negligence of the tenant.

In this instance, since it is not a repair but a replacement, minor repair clause is not applicable, therefore landlord will bear the entire replacement costs, unless there is other applicable clauses for tenant to bear the replacement cost or part of the replacement costs. Has tenant dutifully carry out the maintenance required set out in the agreement?

    is the interpretation. minor repair is for cases where the appliances can be repaired. for things that cannot be repaired, it doesn't fall under this. for. this case of gas leakage, to be fair, if the tenant were to service the aircon regularly, will they be able to avoid this problem? the best solution is to work out a solution with the tenant on how much he or she can pay to co-share the costs.

    Coz tenant has missed out first servicing. Supposed to do once every 3 months but he only did it after 5 months. Some did mention with minor repair clause, tenant is supposed to be responsible for initial $200/unit/replacement and Landlord pays the excess.
