Are an unmarried couple who hold a HDB flat and EC respectively under their own names allowed to get married without infringing HDB's rules on no 2 flats per married couple. Both the flat and EC have yet to cross MOP.

If so, when is the milestone they can get married, i.e: -
1. At the 5-year mark of the EC when it semi-privatised; or
2. At the 10-year mark of the EC when it is fully-privatised; or
3. Not applicable as EC is not even considered a HDB flat in the first place.

Appreciate advice on this, please.

Depending on the family nucleus. For the EC owner, was the brand new EC purchased under Joint Singles Scheme or together with the family?

For lesser complications, the easiest part will be for them to get married after meeting MOP since 1 will be considered a private unit.

    Thanks for the response Siew Fong. Technically speaking before MOP, HDB will not allow the retention of both properties.

    EC was bought in the name of the male partner with his child as occupier forming a family nucleus.

    HDB was bought in the name of female partner with her child as occupier.

    Question is whether the couple can get married before both properties reaching MOP without affecting their eligibility to hold on to their respective properties..

Hi,

Technically the authorities can't stop you guys from getting married, but since both properties are before MOP, they will require you guys to decide property you all want to keep because only 1 property can be retained. To keep both properties, I believe both properties must cross the MOP before you are eligible to keep both, since the EC would have become semi-privatized, and the HDB owner would become eligible to get another residential private property. It is an unique situation which only the HDB Branch can assess and its subject to their final discretion.

HDB views a married couple as a single entity and they expect the couple to stay together under one roof and are not eligible to hold 2 flats. However if it is a genuine case of both units were purchased before marriage then there will be some leeway depending on your situation.
