Hi,

Yes only buyers with valid approved HFE letter can enter an option to purchase for a resale flat. Technically you have not entered any contract with her because she is not eligible to purchase and any agreement thus far will be voided as its not considered legal. It is also unfair for you as a seller to be given the wrong info and have to wait for the buyer and as such losing out on other potential buyers offers. If not comfortable you may wish to return the buyer the $1k and highlight to the agent that this is not a proper arrangement and you would like to discontinue from this.

Yes you are right. HFE must be done BEFORE buyer can pay 1K to secure the OTP.

There is no legally binding contract between you and the buyer yet so you can return them 1k and discontinue the deal.

An HDB Flat Eligibility (HFE) Letter is required before the buyer pays the S$1,000 deposit to secure the Option To Purchase (OTP).
Since there's no Signed OTP:

There's no legally binding contract yet.
You can return the S$1,000 deposit to the buyer and choose not to proceed with the sale.
