Dear sir/mdm,

Did you appoint any agent to represent you for this purchase? Did you conduct any inspection for vacant possession prior to the completion? If you have done so, have you raised any objections for the sellers' belongings and request for a follow up prior to the completion, otherwise you can essentially delay the completion as sellers have not delivered vacant possession and claim interest against the sellers. Are you aware of the above?

I am unsure on the response from the sellers' agent from your request to him or her so it is unwise for us to indicate that you should raise a complaint against the agent, but let's be very objective in this, while I can understand the frustrations you feel as a buyer to have encountered this, but if the seller's agent has already put in multiple reminders to the sellers to remove their belongings but yet sellers have not done so, is it fair to blame the agent in this case?

Agents do not have authorities to remove belongings of owners or tenants from the property in case you are unaware.

Hope this helps! Purchasing a property should be a happy affair, so I do suggest not to let this incident overshadow the joy of moving into your new home this new year!

I have been in the real estate business since 2009, with more than 14 years of experience serving the Singapore real estate market.

I am very active in the residential segment of Singapore real estate market, having transacted hundreds of deals from HDBs to private condominiums and landed properties in Singapore, and have handled many unique cases in sales and purchases as well as rental deals.

Over the years, I have also established a network reaching out to more than 9,400 expatriates, bringing my market presence to both in and outside of Singapore. This has created an additional exposure when I manage my client's portfolios, on top of the conventional on and offline platforms, where other estate agents are relying on. This has allowed me to consistently convert leads into results.

My Answer with regards to your Question:

If you are facing issues with the seller not vacating the property even after HDB completion, and the seller's agent is not being responsive or addressing the matter appropriately, you may consider taking the following steps:

1. **Document the Situation:**

- Ensure that you document the situation clearly, including any communications you've had with the seller and the seller's agent. Keep records of messages, emails, or any other relevant documentation.

2. **Contact the Seller's Agent:**

- Make another attempt to contact the seller's agent, clearly outlining the issue and requesting assistance in resolving the matter. Provide a reasonable timeline for the seller to vacate the property.

3. **Check the Sale and Purchase Agreement:**

- Review the Sale and Purchase Agreement (SPA) to understand any clauses related to the seller's obligation to vacate the property upon completion. This document may provide guidance on the actions you can take.

4. **Consult Your Own Real Estate Lawyer:**

- Seek advice from your own real estate lawyer to understand your rights and options. They can review the contractual terms and provide legal guidance on the steps you can take.

5. **Contact the Property Agent's Company:**

- If the seller's agent is not addressing the issue and you believe there is a case of incompetence, you can consider filing a complaint with the property agent's company. Provide them with details of the situation, including evidence of your attempts to resolve the matter.

6. **Contact the Council for Estate Agencies (CEA):**

- In Singapore, the Council for Estate Agencies (CEA) is the regulatory body for real estate agents. If you believe the agent's conduct is in violation of industry regulations, you can file a complaint with the CEA.

7. **Consider Legal Action:**

- If all else fails, consult with your lawyer about the possibility of taking legal action to enforce the terms of the agreement and secure possession of the property.

It's important to note that legal processes and rights can vary based on the specific circumstances and the jurisdiction. Seeking legal advice early in the process can help you understand your options and take appropriate action to resolve the issue.
