My husband & I intend to sell our HDB flat and upgrade to a bigger HDB flat. However we understand that for a period of 5 years we will no be able to buy a condominium for investment while owning a HDB flat.

If we have sufficient cash and CPF monies, is it possible for me to buy a HDB flat in my sole-name and my family being the family nucleus and my husband buys the condominium in his sole-name?

Hi,

As you and your husband are legally married and considered one married entity/family nucleus, you have to purchase the next HDB together so to qualify under the public scheme. Alternatively, if the finances are comfortable, you can consider cashing out and purchase 2 private properties, 1 in each sole name, 1 for stay the other small unit for investment.

Hi,

When buying a HDB it will have to form a full nucleus meaning both you and your husband's name will have to be inside as you are a couple. It would be advisable to purchase a private and rent out your current flat if you feel like investing in another property or if you are still eligible you can purchase an EC first as it would be a much better investment :D

Hi Mdm,

It does not work this way. By selling your current HDB and purchasing another HDB, you are bounded by a fresh 5-year MOP period, and you and your husband are both not eligible to buy another condominium for the next 5 years, even if your husband is listed as essential occupier for the HDB that you purchase.

As both of you are married couple, one of you must be the owner and the other be at least an essential occupier in order to be eligible under public scheme to purchase a resale HDB. Even you add in your child/ren as one of the owners, the application cant do without either one of you under public scheme.

In addition to that as you know, you have to fulfill 5 years MOP before you can purchase a private property.

Perhaps you can share more with me so I will be in a better position to advise you further.

Evening,

As both of you are married, HDB considered both of you as an entity. Hence even if you opt to purchase the HDB unit with your spouse as essential occupier, both of you are required to observe the MOP before either or both of you are eligible to purchase the second property. Therefore, you can either opt to keep the current HDB unit and buy the second property or sell your current unit and buy another HDB unit or condo.

If we look at the current price trend against the past 4-5 years, you will probably notice that prices are back at where they were about 6-8 years back, meaning to say, the potential upside within the next 5 years could be great if all indicators of the economies are healthy including favourable regulations in place for the real estate market, therefore to enter the market for private residential properties now would be a good option directly instead of opting for another 5years wait in purchasing a bigger HDB which you may miss the low cycle since I believe you should be aware that the option of buying under separate names is impossible by regulations.

Good day madam .

When buying your next hdb , you can be the hdb owner while your husband status as occupier , however even your husband as occupier status need to serve 5 years MOP before buying a private property .

Another option is for your family to buy a EC executive condo , which is a form of cheap subsididised condo .

Or another possibility is sell your hdb and buy 2 private property , each name buy 1 private property only , therefore no ABSD additional buyer stamp duty , no lock in of CPF minimum sum for 2nd property .
