My husband and I are going to get a divorce. The thing is we will only meet the MOP of 5 years in April 2014. How likely is HDB going to allow us to sell our flat in the open market before the MOP? If it helps, my flat is in Bukit Batok Central. Thanks.

Afternoon Sheila,

Standard divorce procedure will take fastest at around 3 to 6 months (Adultery cases with clear evidence) till 4 to 5 years for separation cases. If you are getting your divorce document soon, we can write into HDB and appeal to sell prior MOP. However, this would be subjected to approval.

It would be better if one of you agree to keep the flat and work out the details on how to do it. Based on my experience, if you are not allowed to sell the HDB flat on the open market, it is likely you have to end up selling it back to HDB.

It is best you write in to check with HDB without delay.
