My company is entering into a 5 yr office rental contract. We brought in an Agent after we found the place, so that he could liase with the landlord's agent for the practical and formal issues. This is a case of co-brokerage. Still our Agent invoices us for 2,5 months of the monthly rental price. To my understanding, there should be no fee to be paid by the tenant (us) and that the Agents share the fee, paid by the landlord ? I am wrong here or misunderstood the ethical guidelines.

Are there any documented agreement with the agent you brought in? If you have refer to that.

If there is any misunderstanding - best that you have an open discussion with the agent you brought (appointed by your company?) . . .

In matters of doubt, refer to documented agreement.

Afternoon,

Only resale of private or landed property will the buyer's agent share the commission from the seller agent. Even though, it does not mean that all seller's agent will do that. For all other cases, the agent will be paid by the party that they represent. Furthermore, I would believe that your agent would have let you sign the commission agreement prior you receiving the invoice, right?

Try to talk to your agent and see how things go.

    Case is celear to me. Will need to meet up with the Agent and discuss the contract based on todays input. Bottom line is that if the Agant always get paid from the party he represents, then I there is not much room for negotiation. Should be noted that the Agent did not find the property. We did that, but he was needed for the proper paperwork. Still a hefty commission for some paperwork.
