My brother is a PR in Australia and just turned 35 wishes to buy a flat in Singapore. However he is unable to come back to SIN anytime soon due to covid and other reasons. What kind of legal tools are available to us inorder to assist him in purchasing the HDB property.

Hi Bernie,

Your brother could appoint a Power of Attorney (POA) to act for him for the purchase of his HDB flat.

Do take note that upon the purchase of the flat, he will be required to fulfill a 5-year MOP before he can sell or rent out the flat.

If his plans is to continue to stay in Australia and rent out the property in Singapore, he should consider private residential instead.

Hi Bernie,

1) An OTP will need a signature to exercise from the buyer. And the buyer will need to be present at the completion to sign all legal documents on the completion date.
2) The rest of the process still possible to be done using the online service provided by HDB, including all payments.
3) Signing of OTP still possible using courier service. However, I have noticed that courier service hardly can meet the deadline due to the current pandemic situation.
4) Thus the best way to process the whole buying procedure, it is recommended to appoint a Power of Attorney (POA). POA can run the whole show without the legal buyer.
5) You will have to liaise with a conveyance lawyer to understand the fees and the process.
6) Note that he needs to fulfill the MOP as others. If he decided to rent the whole unit out and managed to receive approval from HDB. This rental period will not be counted in the MOP.
