I'm a Singaporean age 34 , I'm staying in my parents 3 room hdb fully paid. My mom passed away 5 years ago and my dad is in a nursing home for the past 3 years , what can I do with the hdb in future? I need advice please

Dear Priya,

As you have mentioned that your dad is in a nursing home, may I know who are the current legal owners of this property? If you are comfortable to disclose more about the condition of your dad, we maybe able to provide options for your considerations further. For example if you dad is still able to make sound decisions, then perhaps it could be good to arrange for someone to be appointed as the Lasting Power Of Attorney in the event that he is unable to make decisions, or perhaps apply to be the Deputy in the event that your dad is unable to make any decisions should you be planning to sell the property. The latter process could take longer to effect. Do you have any siblings where you will need any discussion before making any decisions?

    Hi Priya, thanks for responding here. Since your dad is stable, it is advisable to do up the lasting power of attorney first, in case of situation where he is in an unfit conditions to make any decisions, whether to sell or rent, so the appointed person will be able to sign on such documents. A lasting power of attorney is not only limited to real estate matters but also others so it will be good to speak to a lawyer on this matter. Since you are the only child and that if you are the only next of kin (assume grandparents are no longer around), a will may not be necessary but it will be good to speak to the lawyer as well since it involves estate planning. Should you require any contact to do up these documents, I can recommend you a law firm which I have always trusted to handle my clients' matters. Let me know. :D

    The owners of this property are my parents but mom passed away , my dad is in the nursing home because his both legs got amputated. He is stable and can make his own decision I just want to know what happens to the house if anything happens to him as I'm just an occupier and I'm the only child

Good morning Priya,

No offence but you can consider to do the following:

1) LPA (lasting power of attorney)
- to grant you rights to make decision or act in the event your dad lose mental capacity.
(I also done so)

2) Will
- advisable to do a will so you have the legal rights as an executor to handle any matters in regards to the HDB in the event if your dad passes on.

    good evening priya, it will be good to do both. If there's no will, you have to go through a longer period in order to be the administrator of the property if your dad passes on in future. You should hear a lawyer out in regards to the options.
