If I pay rent to main tenant and do not directly pay it to the landlord, does that mean main tenant has sublet the place to me?

The main tenant basically compiles the rent and pay it to the landlord. Also I never sign contract with landlord. The main tenant was the one who sign with the landlord

It depends on the agreement signed and also if your name is reflected as an occupant for the rental. Not sure what your concern is though. Read More

Yes as you did not sign the contract directly with the rightful owner and that’s the risk if the supposed tenant did not pay rent.

TESTIMONIALS from our Happy Clients:

“We'd like to thank you …for assisting with the sale of our previous flat and purchase of our current home. You have kept us regularly updated throughout the process and demonstrated integrity during negotiations and final transactions. You have basically earned our trust as truly hard-working, diligent property agents. Would gladly recommend you to others. Wishing you all the best in your future endeavours. “ Mr Nathan

“It has been our pleasure working with you for the disposal of our flat. You have put in the effort more than what you should have in helping us manage the buyers especially the Tan family.
We did also see the assistance you've provided to the Tan family where they were not represented by any agents and we've been impressed by your professionalism & not to mention the time you've taken to travel, at the buyers request, etc, etc.
We appreciate your efforts and wishing you both prosperity as we usher into the year of the Snake.
Thank you” Ms Karen Read More

Yes, in this situation, you are most likely living in a sublet. Here's why:

>>Rent Payment: You're paying rent to the main tenant, not directly to the landlord. This is a key indicator of >>subletting.
>>Contract Absence: You haven't signed a contract with the landlord, which is typical in subletting arrangements. The main tenant has the original lease agreement with the landlord.
Here are some additional points to consider:

>>Legality: Subletting may or may not be allowed depending on the terms of the main tenant's lease agreement with the landlord. It's always best to confirm if subletting is permitted.
>>Your Rights: As a subtenant, you may have fewer rights compared to a tenant with a direct lease from the landlord.
>>Protection: If there are any issues with the property or the main tenant, you might have limited recourse compared to a direct tenant.
Here's what you can do:

>>Ask the Main Tenant: Speak to the main tenant and inquire about the subletting agreement and any specific rules or requirements.
>>Consider a Proper Sublet Agreement: If subletting is allowed, discuss the possibility of a formal sublet agreement with the main tenant. This can help clarify your rights and responsibilities.
>>Contact the Landlord (Optional): If you're comfortable, you could try contacting the landlord directly to inquire about the subletting situation. However, be aware that they might not be open to communication if they haven't approved the sublet.
***Remember: It's always recommended to have a clear understanding of the living situation, especially when subletting is involved.
