I would like to acquire about the procedures and process pertaining to the sales of flat by a divorced, Undischarged Bankrupt, in particular, the necessary compliance, time line for the entire process and the distribution of sales proceeds between the co-owners.

What is the average time line difference between a "undischarged bankrupt Vs a Standard, regular sales transaction?

What are the typical challenges faced in this type of sales?

For divorce, the court order will advise on the handling of the matrimonial assets. If the decision is to sell, the distribution of proceeds will be advised. The requirement is the final court order for salesperson to proceed with the sales process. As for the bankruptcy issue, it is good to check and confirmed with the OA that the cash proceeds will not be affected. Other than that, the sales process is as per normal. You should have the court order which will indicate the instruction for the matters on your existing HDB unit. To proceed with the marketing, you will need to engage an agent, inform your OA on the intention of sales and during submission of application to HDB. The rest of the procedure and timeline is the same to standard HDB resale transaction.
