I want to purchase a resale HDB as Husband and Wife, one as owner and another as occupier, with tenancy in common scheme. Can the occupier purchase a private property after MOP met without ABSD? Context is if shareholding under tenancy in common makes the occupier a de facto shareholder.

It is possible to list your wife as an occupier. However, she must not have an interest in the property.

Hi,

Based on current policy, yes as occupier she can purchase private property after MOP met without ABSD incurred. However, as occupier she cannot use her cpf for the property or use her income to apply for the loan.

Hi,

First of all congrats to your decision of purchasing a home!

Basically, just to explain how things works in terms of ownership. When you want to put your wife as an occupier, then she is not an owner of the house. So the part of owning under Joint Tenancy or Tenancy in Common does not apply. You will be the sole owner of the house. But because she is your wife so even when she is an occupier, she is considered an essential occupier and she will need to fulfil the MOP period just like you. The beauty is after the MOP period, she can purchase a private property and she will not be subjected to ABSD.

Additional points to note will be, even though your spouse is only an occupier, when you want to sell your house in the future, the spouse will also need to give consent before you can sell. This is called the Spousal Consent. Another thing will be, if she is the occupier and not the owner, she cannot use her CPF in any way to contribute to the house.

If now you purchase the house under the Tenancy In Common manner, then she will be considered an official owner. So after the MOP, if she purchases a private property, she will have to pay the ABSD.

Hi,

If this is what you plan to do, you can only purchase as Sole Lessee. As there is only 1 owner, the property cannot be under Joint Tenancy or Tenancy-in-Common.

If you're going for a HDB flat, the other party needs to be an essential occupier, and will be bounded by the MOP rule. After MOP is met, the occupier can proceed to purchase his/her first residential property. ABSD, if any, depends on the stamp duties imposed at that particular point of time. I cannot comment whether there will or will not be ABSD for Singaporeans purchasing first property 5 years down the road.
