I have signed an otp since Aug and paid $5k deposit to my seller who is a divorcee. However the otp cannot exercise as the seller's ex-wife has appealed to the court to authorise to sell the flat. This case dragged for 3 mths and now I wanted to back out the decision to buy the unit. But the seller used up my deposit and not able to return me the money. Other than seeking legal advice, what other ways can I claim back my deposit? Can I go to CASE or small tribunal court?

I share your empathy.

I was wondering at the time when you signed the OTP and paid the balance deposit, were you already aware that the seller is a divorcee?
In dealing with selling a property involving divorce, usually the seller agent is required to qualify the eligibility of selling (besides just verifying if the divorcee has got an Absolute Decree Nisi) and that if it is an exclusive sale, both the signatures of the seller (husband and wife) are preferably presented on the Agreement To Sell.
I could best guess that this was not done.

As the case now involves the ex-wise wanting to have a share in the selling decision, this procedure may take longer than expected and can become complexed.

I suggest that you begin talking to some lawyer friend for the advice and study if there should be a way to exit from the purchase and get back the deposit and damages. If I could further assist you in this, pls let me know. SMS/ Call me at 9876 5130  to discuss.
