I am divorced for a year+, with a decision to sell now. MOP has already passed, no court order to sell by whatever date. My ex-wife is a PR(malaysian). We had a 40k grant when we bought our JW flat, with the 40k banked into my cpf and used for the housing. We had an agreement to split all proceeds 50-50, but I understand that I would have to pay a levy of 40k back when i purchase another resale in future. How do I ensure the 40k grant does not get shared by her/ or justify to her?

Morning Dave,

You are required to pay levy of $40k only if you apply for another new HDB unit as your current 4 room flat is considered as subsidized unit. HDB housing grant are only given to SC so it's unlikely for you to get $40k grant. Check this detail out with HDB.
