Hi, what will happen if the Buyer had signed the Option to Purchase, and the Seller had agreed and signed with the purchase. And subsequent check found that the seller had not met the MOP, thus is not able to sell the property. What are the options available for the Buyer? Thanks.

HI NTL,

There are not much options available for the buyer. Even if you appeal to HDB, there is no way they will bend around the rules to go through with the completion. The whole sale will be void.

The only option is to retrieve the option fee you have paid to the owner and look for another unit.

    Hi Jenna, thanks for the reply. In current situation, is it possible to defer the exercising of the option so that the MOP can be met? The seller is just a few weeks to MOP.
