Hi,

Wanted to check with you guys here:
Can I sue the seller / agent when they have accepted my offer through whatsapp?
The seller agent inform me, they will proceed with the OTP and accepted my offer, and I've provided them my intent to buy with my details for them to prepare the OTP.
but the next day they informed me they've given the OTP to another buyer.
No option fee given yet, because they have yet to provide my bank account.

Hi ER,

For your case, sorry there is no basis to sue as the seller has not officially accepted your offer and to sign on the OTP.

    so in a way, I just suay kanna a seller / agent that cant keep his word,
    not sure whether the part to keep to his word / honor the deal is part of the property agent code of ethic.

You can sue, since there is an agreement already provided in the form of whatsapp message, however, you will need to spend money to do that so whether or not it is worth the cause for you to do so you need to decide.

At the end of the day, purchasing a property should be a happy occasion therefore if I were in your position, I will treat this as a lesson learnt and be more prudent in my negotiation with seller and agent. This is also 1 of the key reason why some buyers prefer to appoint an agent even though agent fees is applicable for HDB resale purchase instead of going DIY just to save that amount. If you have an agent representing you in this negotiation, I can only say that he or she lacks the. experience for such negotiation.

1) There is no contract formed when you put up your offer without any consideration (money).
2) The seller has all the right to give the OTP to another buyer even after verbally agreeing (including a written agreement) to your offer.
3) You have no case against the seller or the seller's agent.
4) You will need 3 elements in order to form a legal contract.
