Hi property gurus, a seller's agent recently proposed to me that seller will accept lower OTP value in exchange for me to pay the seller agent commission instead. Can I know if this is legal?

Hi,
Buyers normally do not pay commission to their agent nor the seller's agent. Seller's normally pay their agent. However, if it makes business sense you can try. If after factoring the agent's commission you still gain... why not? There is no hard and fast rule on this matter. It all depends on your negotiations.

Somehow I do not see the difference in you paying the commission or seller paying the commission.

For example if transaction price is $400k, seller commission is $8k. If seller do not want to pay, then negotiate for $408k to close so seller has zero loss. Of course, I have not factored in the GST payable as well as your buyer stamp duty which will be based on the $408k instead of $400k.

I have a feeling although I cannot be firm, that this agent will have a colleague who will be collecting the commission from the seller in this transaction, so he is trying to work his way into becoming the buyer's agent in this transaction. Read More
